We’re not against the police.  We’re not against the police department, but we are against police who commit misconduct (and those who help cover it up).

This one goes out to all of the people who jumped on the bandwagon of two so-called community activists in decrying the work of civil rights lawyer Caree Harper on behalf of CHP beating victim Marlene Pinnock. It will be interesting to see what those same activists and haters have to say after this news breaks.

This story has been updated.  Updates appear at the bottom.

I am telling you now, family can be your worst enemy.

Unless there is a continuance, CHP beating victim Marlene Pinnock’s daughter Maisha Allums and Los Angeles County doctors will try to put her in a County mental health lockdown facility for one year today.  You may not hear about it in the news, especially with the Hollywood stabbing of a tourist–but nevertheless that’s the case.

So here’s the backstory.

First, it should be noted that Ms. Pinnock wants other options utilized and technically, she can afford the best of care.

Since the date of her incarceration, Oct. 6,  she has only had one raggedy sweatsuit to wear and that ain’t right.

She has advised attorney Caree Harper on her condition and allowed her to disclose that her own daughter Maisha has been receiving disbursements from her trust account for the last four months and recently picked up her social security check (that part).

Ms. Pinnock is of course still the beneficiary of the trust funds from the settlement she received as a result of being beaten nearly to death on the side of the 10 freeway, but she has not been allowed to pick her own doctors and lawyers nor has she been allowed to participate in selecting a treatment facility or a treatment plan, although she is currently under medication and lucid again. She says that she recognizes the serious need for care and counseling, but that County facilities leave much to be desired. Unless there is a continuance, she will be represented by a public defender at her hearing today.

Caree Harper was just given the details of the hearing yesterday afternoon, and it is unlikely she will be able to make today’s hearing.  But that’s really neither here nor there.  Technically, Caree isn’t her attorney on this case.  Her case was the case against the CHP and that was settled.  Anything above and beyond that would just be as a courtesy to Ms. Pinnock. However, Ms. Pinnock’s aunt Ms. Brenda Hall-Woods was supposed to be present and so was her childhood friend India Mack.

Her daughter and son-in-law were also expected to attend. According to Ms. Pinnock, they want to be “compensated for the years they had to deal with” her. They are angry with Ms. Harper because the bulk of Ms. Pinnock’s money is locked down in a special needs trust.

It should be noted that the start of Ms. Pinnock’s downward spiral came after Federal Court Judge Otis Wright declared that Ms. Pinnock had been exploited by Ms. Harper.  A claim that both women continue to refute.

Judge Wright’s statement and the ensuing news stories prompted two South L.A. community activists to call for the State Bar of California to investigate Harper and at least one of them to take it a step further.

The activists misguided meddling helped to destroy Ms. Pinnock’s support system and paved the way for her daughter to gain control over her money by setting the stage for her own mother to be found on the street and once again taken into custody.  With the support system in place Marlene Pinnock was medicated and sober for nine months which is her longest period of sobriety in two decades. She was also crystal clear about folks in her family who were trying to get her money.

Everyone agrees Ms. Pinnock needs serious help–even Ms. Pinnock.   However, Ms. Pinnock is not being afforded lawyers and doctors of her choosing or the opportunity to review evidence against her that’s being used to lock her for a year. According to Caree Harper, she needs prescription glasses and she does not have them so there is no way she can even read her own file.

And let’s be clear, Marlene Pinnock is not poor.  Why should she be forced into a County mental facility?

Family members trying to get their hands on relative’s money by any means necessary is nothing new. However, this situation happened in part thanks to two so-called community activists and one judge who didn’t know what he was talking about when he went on a rampage against Ms. Pinnock’s then-attorney. I wonder now if those same activists are going to have a press conference and come to Ms. Pinnock’s defense  or just sit back and watch her family take her money and lock her up.  It doesn’t really matter to them I guess now that the cameras are gone.  Besides–it’s not their money.

Even though Caree Harper is not the attorney of record for Ms. Pinnock anymore she was able to get a continuance until December 2 in an effort for Ms. Pinnock to be able to hire her own lawyers and doctors to assist in fighting her daughter and son-in-law who are trying to have her committed to a County mental health facility for one year and she believes, steal her money. Ms. Pinnock will remained incarcerated until that hearing.
